
Since the opening of the firm in White
Plains in September of 1998, Penino &
Moynihan, LLP have opened offices in
Uniondale, NY and Stamford, CT.
Penino & Moynihan, LLP has represented
the insurance industry in defense of
cases involving personal injury and
property damage; professional errors
and omissions policies; and motor
vehicle accidents.

Mr. Penino and Mr. Moynihan are hands
on litigators who closely monitor all

verdicts and successful summary
judgment motions on behalf of

carriers and their insureds.
Included among Penino & Moynihan,
LLP’s

The firm has expanded its areas
of practice into medical malpractice
defense, insurance coverage analysis
and claims management, areas of law
with which the General Partners, Mr.
Penino and Mr. Moynihan, and all other
attorneys with this firm are closely
familiar with.
He commenced the practice of law in
1985 as an Assistant District Attorney
at the Queens County District
Attorney’s Office in New York City.
Mr. Penino served as a Prosecutor for
nearly four years in both the Rackets
&
Economic Crime and Homicide Bureaus,
where his litigation skills were
developed and honed.
Subsequent to serving as a prosecutor
Mr. Penino began his work in the
Insurance Defense area. Initially he
worked as an associate at a major
Manhattan firm specializing in Medical
Malpractice Defense litigation. In
1991
he relocated to the White Plains area
of Westchester County where he has
practiced to this day.
His work in Westchester centered
around
Insurance Defense and Commercial
litigation matters. Additionally Mr.
Penino specialized in Municipal
Defense
arguing nearly a dozen matters before
the Appellate Division Second
Department, prevailing on each and
creating new law at times.
In 1998 Mr. Penino was instrumental in
forming what is now the present firm.
Currently he specializes in all
aspects
of litigation concentrating on
Commercial & Insurance Defense matters
and Professional Errors & Omissions
suits. Recently he has begun
conducting
Risk Management Seminars for local
real
estate brokers. These have been met
with great enthusiasm by the local
brokers.
He was appointed as an Assistant
District Attorney in New York County
in
1963 and served in that capacity for a
period of six years, during which he
successfully prosecuted major criminal
defendants in the Criminal Division of
State Supreme Court. Thereafter, he
served, by special appointment, as a
Special Assistant Attorney General of
the State of New York for a period of
two and one-half years before entering
the private sector. Since that time
he
has specialized in insurance defense
litigation.
Before joining the firm of Penino &
Moynihan, LLP, as a member, in July,
2000, Mr. Moynihan was a senior
litigation partner, for approximately
fifteen years, in a major insurance
defense firm where he obtained
numerous
defense verdicts in both State and
Federal Courts. He has vast
experience
in the insurance defense area,
including but not limited to
construction law, labor law, products
liability and medical malpractice.
As a member of Penino & Moynihan, LLP,
Mr. Moynihan continues to specialize
in
insurance defense litigation and is
deeply involved in defending claims
involving virtually all aspects of
insurance litigation, with an emphasis
on construction law, labor law and
products liability.
Mr. Falch commenced the practice of law
in 1995 as an associate at a small
negligence firm in Manhattan. Since he
began practicing law Mr. Falch has had
experience litigating both plaintiff
and defense work.
Subsequent to working in lower
Manhattan, Mr. Falch worked as an
associate at a plaintiff’s negligence
firm in White Plains. In this
position, he was involved in
litigating
matters involving premises liability,
automobile accidents, labor law and
medical malpractice.
Prior to graduating from law school,
Mr. Falch worked for the New York
State
Department of Environmental
Conservation – Division of Hazardous
Waste.
He is a member of the American Trial
Lawyers Association, the New York
State
Trial Lawyers Association and the New
York State Bar Association. Mr. Falch
has served as New York State Bar
Association continuing education
lecturer and has spoken at seminar’s
involving Basic Tort and Insurance Law
and Labor Law.

all
aspects of State and Federal
litigation
with an emphasis on Insurance Defense
matters.
At the Washington College of Law, Ms.
Wallace was a Member of the Journal
for
Gender and the Law. Her studies
included areas of commercial
litigation, corporate and tax laws.
While attending law school, Ms.
Wallace
was employed as a law clerk with a
Washington D.C. law firm engaged
primarily in civil litigation
specializing, in securities and
consumer fraud class action litigation.
Ms. Wallace has been associated with
this firm since January
2000. Her practice areas have
encompassed all aspects of civil
litigation, with an emphasis in the
areas of insurance defense matters.
In
addition, Ms. Wallace has prior
experience in antitrust, consumer
fraud
and products liability class action
litigation. Ms. Wallace has been a
Member of the New York State Bar
Association since January 2000, and
the
Connecticut State Bar Association
since
November 1999.
